The Biden administration’s aggressive prosecution of Americans who participated in a rally on Capitol Hill in January 2021 exposed that Justice Department’s bias against supporters of President Donald Trump.

Now that Trump is back in office, he is taking strides to reverse the impact that his predecessor’s DOJ had on the lives of so many individuals.

As the Daily Caller reported, the latest example involves a numbers of leaders within the so-called “Proud Boy” movement, which helped organize aspects of the Jan. 6 demonstration:

In a consolidated appeal before the U.S. Court of Appeals for the D.C. Circuit, the DOJ asked judges to wipe out the convictions of former Proud Boys leaders Ethan Nordean, Joseph Biggs, Zachary Rehl and Dominic Pezzola and send the case back to the trial court so prosecutors can formally move to dismiss the indictment with prejudice. Federal prosecutors argued that vacating the convictions would allow the DOJ to exercise its discretion and end the case entirely under Rule 48(a) of the Federal Rules of Criminal Procedure.

They told the court that dismissal serves the interests of justice and aligns with the executive branch’s current position on the prosecutions. The filing comes after President Donald Trump commuted the defendants’ sentences on Jan. 20, 2025, reducing their punishment to time served but stopping short of issuing full pardons. That decision left their convictions intact even as it cleared the defendants from prison.

The DOJ is seeking to go a step further by eliminating the convictions themselves. Prosecutors told the court that the government no longer considers continued prosecution appropriate, citing a broader reassessment of similarly situated cases tied to the Jan. 6 Capitol attack.
News of the Trump administration’s action has sparked conversation on social media:

Excellent. This was a fed entrapment operation. Ask Fanone all about it. pic.twitter.com/W1nRI0EvX2

Never fit the criteria for those charges, we lived under direct fascism while being called the fascists.

The Hill provided additional coverage of the DOJ’s move:

The move could wipe away the final convictions tied to the Capitol attack.

“In the Executive Branch’s view, it is not in the interests of justice to continue to prosecute this case or the cases of other, similarly situated defendants,” wrote Daniel Lenerz, deputy chief of the appellate division within the U.S. Attorney’s office for D.C.

The Justice Department’s request came ahead of key deadlines in the extremist group leaders’ appeals.

Former U.S. Attorney General Merrick Garland once described the Jan. 6 probe as one of the “largest, most complex, and most resource-intensive investigations” in the Justice Department’s history. Its crown jewel was the sedition convictions of the Proud Boys and Oath Keepers.
