The Virginia Senate this afternoon passed a constitutional amendment allowing abortion at any point in pregnancy. The amendment would also eliminate parental consent, end health protections for women and girls, and force taxpayers to fund abortion. The vote broke along party lines with 21 Democrats voting in favor and 19 Republicans opposing. Democrats voted down Republican-proposed changes to the amendment to protect parental rights and the lives of babies who survive abortions.
To be placed on the ballot, the amendment must be approved by the General Assembly again after the November election. The amendment would eliminate Virginia’s current law limiting abortion at 27 weeks, during the sixth month of pregnancy.
SBA Pro-Life America Regional Political Director Caitlin Connors commented on the vote:
“The stakes of Virginia’s legislative elections this November just got higher. Virginia already allows abortion in the sixth month of pregnancy, but that isn’t enough for Democrats. Republicans must hold Democrats accountable for supporting abortion in the third trimester, the end of parental consent and denying abortion survivors the right of lifesaving care.

“We thank senators Tara Durant and Emily Jordan for attempting to provide well-supported, commonsense changes to the amendment by adding born-alive and parental rights protections. Every single senate Democrat opposed both additions, demonstrating their allegiance to the abortion lobby over the will of Virginians. It’s time to vote them out.”
In contrast, Gov. Glenn Youngkin’s budget proposal includes measures to help mothers and protect more unborn children. His budget would stop state funding of abortions of babies with disability diagnoses and provide more than $4 million for pilot programs to improve maternal health, more OB-GYN residencies, and expansion of doula and midwife support.
By six months gestation, a baby born prematurely can survive outside of the womb. At 22 weeks, the baby has an 18.9% probability of surviving their first year. The odds increase to 81.7% at 25 weeks gestation. During this stage, the baby not only responds to touch and practices breathing but responds to sound and light and can grasp objects.
