The Pennsylvania Supreme Court on Monday handed a victory to Republican David McCormick for U.S. senator from the Keystone State.

The state high court ruled on the recount of votes for the U.S. senator’s race between McCormick and incumbent Democrat Sen. Bob Casey that mail-in ballots with either missing or incorrect dates are not to be counted.

The court’s ruling was a repeat of its earlier decision. Pennsylvania Democrats had been moving ahead with what was reported to be a more-than-$1-million vote recount in the race that the Associated Press had already called for McCormick.

The majority-Democrat court’s ruling appeared not to matter to Secretary of State Al Schmidt and Democratic officials in Philadelphia and Bucks, Centre, and Montgomery Counties.

Even the Washington Post editorial board on Friday denounced the Democrats for voting to defy the state high court’s ruling in hopes of gaining a victory for Casey.

“Democrats would surely protest if a Republican commissioner made the same statement to justify tipping the scales for their party’s Senate nominee,” the editors observed.

“These Democrats’ decisions will almost certainly be overturned on appeal, but the mere attempt to defy judicial rulings is corrosive to democracy and invites similar behavior in future elections,” the editors asserted, referring to Bucks County Commissioner Democrat Diane Ellis-Marseglia’s overt statement of disregard for the ruling as a “breathtaking rationalization.”

“I think we all know that precedent by a court doesn’t matter anymore in this country,” Ellis-Marseglia had said, per the Philadelphia Inquirer. “People violate laws anytime they want. So, for me, if I violate this law, it’s because I want a court to pay attention. There’s nothing more important than counting votes.”

According to Fox News, Schmidt announced last week that the state “would proceed with the recount, noting that counties across the Keystone State had reported a total of some 80,000 uncounted provisional, mail-in or absentee ballots.”

Schmidt reportedly said the recount would continue through November 26.

McCormick held a margin of victory over Casey of about 17,000 votes, an outcome that was within the 0.5% threshold required under Pennsylvania law to prompt an automatic recount.

“In Pennsylvania, the politics of despair has stripped away all principle and pretense,” remarked legal scholar Jonathan Turley, author of “The Indispensable Right: Free Speech in an Age of Rage.”

In his column Monday, Turley likened Ellis-Marseglia’s words to those of a “Chicago gangbanger or Washington car thief.”

“Rather than prompting a degree of introspection, the loss of both houses of Congress and the White House has had a curious effect on many Democrats, dropping any pretense of protecting democracy over partisanship,” he observed. “Despite polls showing that the public trusted former president Donald Trump more than Vice President Harris in combatting threats to democracy, Democrats made ‘saving democracy’ the thrust of this election.”

Democrats, Turley continued, nevertheless proceeded to “save democracy” by “calling for blocking dozens of incumbent GOP officials and legislators from ballots as ‘insurrectionists.’” The Democrats also moved to protect democracy “through the most extensive censorship in history and the blacklisting of opponents.”

Republicans condemned Democrats for refusing to concede the Senate race, asserting any change in the outcome would not be significant.

“What’s taking place in these counties is absolute lawlessness,” Pennsylvania Republican Party Chair Lawrence Tabas said, adding, “There’s no mathematical way to achieve what the Casey folks apparently think they can achieve.”

Senior GOP officials on both the national and state levels announced Monday they were filing 12 lawsuits in the Keystone State in order to “aggressively” defend the Senate seat.

“Democrat officials are on video saying that they’re going to choose to break the law, and there will be legal consequences for that,” a senior party official reportedly told Fox News.

Republican Party Chair Michael Whatley told reporters that Republican National Committee officials were “coordinating closely with Dave McCormick’s campaign to ensure that this hard won Senate seat will be protected.”

“The RNC and the Republican Party of Pennsylvania are aggressively fighting back to bring an end to this corrupt and despicable conduct,” Whatley said.
