When Dems deliberately stack the courts with radical leftists, it was only a matter of time before their activism overtook their proper role in the courts. It didn’t take long at all.
A judge that squeaked in during the last few days of President Autopen’s term (we are still sorting out the legalities of whether that appointment was even valid) has been at the forefront of the left’s agenda of using lawfare to throw sand in the gears of legitimate functions of the Trump administration’s official duties.
One of their primary attacks against the administration involved throwing everything but the kitchen sink at blocking efforts to send illegal aliens home. Surely it’s merely a coincidence that these are the same people who fought like honey badgers to block any attempt to put barriers of any sort along the Southern border, or a defunding a virtual army of NGOs that cashed in on taxpayer money hand over fist backstopping this and other Democrat causes.
Judge Brian Murphy has been punching far above his weight class in making sweeping restrictions on what the Trump administration can and cannot do in their handling of illegal immigrants.
The power and celebrity of being a NeverTrump judge has obviously gone to his head.
How can we know? Simple: when SCOTUS tells a judge he’s out of line, a lower court is obligated to fall in line with the instructions of the higher court.
Unless he’s a radical activist. Then he will do whatever the hell he pleases.
You can guess which one he is.
SCOTUS granted a stay on the order issued by Judge Murphy. But he is ignoring it, and insisting that his ruling remain in place ‘notwithstanding’ the stay that has been ordered by SCOTUS.
A bold move, since the Supreme Court takes its power directly from the articles of the Constitution itself, whereas the lesser courts are comprised by an act of Congress, and are subject to such legislative remedies as Congress deems appropriate.
The DOJ, naturally, has gone back to SCOTUS to see what they have to say about it.
Here is Sen Eric Schmitt ripping the judge a new one in the Senate. He invokes the word ‘insurrection’, a word with which the left is well-acquainted.

Impeachment of a judge would be difficult enough if it only took a one-vote majority. But under the rules of the Senate, it takes a 60 vote majority, which means convincing at least seven Democrats to cross the aisle and vote to impeach a judge they voted to install six short months ago.
Not going to happen.
But that is not the only recourse. From the government’s own description of the articles of the Constitution:
With respect to the lower federal courts, the constitutional authorization for Congress to from time to time ordain and establish inferior courts may imply that Congress can alter the system it establishes, including by eliminating exiting [sic] federal courts. — Constitution Congress
It has been suggested that it would only take the 50 plus one vote majority to zero out the budget of a court that has gone rogue.
Sure it would be fought in court. But it’s a drawn out process, which ought to also trigger disbarment proceedings. Once you make an example of one radical judge, others might think twice about exceeding their authority if it means losing their gig and becoming a martyr for the cause.
