Salvadoran native Kilmar Abrego Garcia, who was deported to his country of origin under the Trump administration, is now heading back to the United States to face criminal charges. Abrego Garcia is being charged with transporting undocumented migrants within the U.S., according to sources who are close to the situation.
Two months after the current administration deported Abrego Garcia from the state of Maryland back to El Salvador, a federal grand jury has now indicted him for allegedly transporting illegal migrants inside the country. He faces two counts according to the indictment, which alleges that Abrego Garcia took part in a years-long conspiracy to traffic illegal immigrants from Texas to places deeper within the interior of the country.
According to ABC News, the conspiracy lasted almost a decade and generated loads of cash by transporting thousands of illegal individuals domestically who hailed from Mexico and countries in Central America. This included children as well.
Members of the horrific MS-13 gang were among the folks allegedly transported.
An attorney representing Abrego Garcia gave a statement to ABC News, stating his intent to keep fighting for his client and ensure he receives a fair trial.
“From the beginning, this case has made one thing painfully clear: The government had the power to bring him back at any time. Instead, they chose to play games with the court and with a man’s life,” attorney Simon Sandoval-Moshenberg explained. “We’re not just fighting for Kilmar — we’re fighting to ensure due process rights are protected for everyone. Because tomorrow, this could be any one of us — if we let power go unchecked, if we ignore our Constitution.”
“Abrego Garcia, a Salvadoran native who had been living with his wife and children in Maryland, was deported in March to El Salvador’s CECOT mega-prison — despite a 2019 court order barring his deportation to that country due to fear of persecution — after the Trump administration claimed he was a member of the criminal gang MS-13. His wife and attorneys deny that he is an MS-13 member,” the report said.

The Salvadoran, now on his way back to the U.S., is facing charges after a series of high-level diplomatic discussions between Trump administration officials and the government of El Salvador.
The Trump administration admitted in court filings that Abrego Garcia’s deportation in March was in error, due to violating a U.S. immigration court order from 2019 that prevented Abrego Garcia from being sent back to his home country.
An immigration judge determined that if the man were sent back to El Salvador, there was a possibility he could be terrorized by the same local gangs that had already caused problems for his family.
The administration made the case that Abrego Garcia should not be brought back to the United States because he himself is a member of MS-13. His family and legal representatives have denied this claim over the course of recent weeks. Officials in the Trump administration have pointed out the issues Abrego Garcia has had with police over the years.
