In another big victory for the Trump administration, the 8th Circuit Court of Appeals just ruled that ICE is allowed to detain illegal immigrants without bond while deportation proceedings take place.
The 2-1 decision overruled a prior ruling made by a leftist judge who tried to force dangerous catch-and-release policies for illegal criminals.

The court’s ruling specifically applies to immigrants who have been evading the law and living illegally in the United States.
It makes it very clear that illegal aliens are not entitled to the same due process as U.S. citizens.

This marks the second straight win from an appeals court related to ICE’s detention policies.
Immigration authorities now have a definitive go-ahead for detaining and deporting millions of illegal aliens who have been residing in our country without having to deal with delays for bond hearings.

A second federal appeals court has blessed the Trump administration’s policy of locking up the vast majority of people it is seeking to deport without a chance for bond — even if they have no criminal records and have resided in the country for decades.
A panel of Republican appointees on the 8th Circuit Court of Appeals ruled 2-1 Wednesday that the administration had properly determined that federal law doesn’t only allow — but requires — ICE to detain the vast majority of people it is seeking to deport. That includes millions of immigrants who have long been treated as eligible for bond hearings.
The ruling carries particularly acute implications for Minnesota, where federal district judges are bound to follow it. Hundreds of people detained during the recent ICE crackdown in the Twin Cities have filed petitions for release from custody by challenging the administration’s interpretation of the law, and nearly every district judge in the state had sided with the petitioners.
Judge Bobby Shepherd, a George W. Bush appointee, wrote the majority opinion, joined by Judge L. Steven Grasz, a Trump appointee. Another Trump appointee on the panel, Judge Ralph Erickson, dissented.
Federal district court judges in 40 states — appointed by every president since Ronald Reagan — have largely recoiled at the policy. More than 400 have rejected the administration’s approach, ruling against ICE in more than 5,000 cases. Just 41, nearly all appointed by President Donald Trump, have backed ICE’s new interpretation in about 250 cases.
But the St. Louis-based 8th Circuit’s decision is now the second appellate win for the administration, following a 2-1 5th Circuit ruling last month that binds district court judges in Texas, where thousands of ICE detainees are held. The two circuits are widely seen as the most conservative in the country, and similar cases are pending in several other circuits, including the San Francisco-based 9th Circuit and the Chicago-based 7th Circuit, which have seemed inclined to oppose the administration’s view.
