A memorandum of understanding between Customs and Border Protection (CBP) and the State of Texas will grant the Texas National Guard permission to make immigration arrests, according to a report from Breitbart News.

The memorandum, which was authored by acting CBP Commissioner Peter Flores, has not yet been distributed to all Lonestar State border sectors. The new guidance will allow National Guard personnel to perform daily patrols and execute all duties of an immigration agent so long as they are accompanied by an immigration officer or CBP agent.

Once enacted, the policy will provide a much needed manpower boost as the Trump Administration attempts to ramp up mass deportations. President Trump previously issued quotas that will require Immigration and Customs Enforcement (ICE) and other border officers to make anywhere between 1,200 and 1,400 arrests every day. The numbers are currently lagging, as ICE reported under 1,000 arrests in Saturday’s operations.

According to preliminary guidance under the memorandum of understanding, one border officer or CBP agent will be required for every four National Guardsmen, according to Breitbart News.

As part of President Trump’s move to declare a national emergency over the border crisis, several agencies were given power to make arrests under Title 8 United States Code. On January 23, the Department of Homeland security authorized agents to locate and detain any and all individuals who entered the United States illegally, starting with those who present high profile public safety threats. That memorandum, which was initially reviewed by CBS News, contained similar wording to the document reviewed by Breitbart News on Sunday.

The new guidance is expected to free up roughly 3,000 Texas national guardsman for deportation efforts, providing a massive boost in manpower for immigration agents. President Trump has already freed up agents from several agencies, including the ATF, DEA and DHS, to make arrests under the national emergency declaration.

During the Biden presidency, Texas repeatedly took steps to stem the record flow of illegal immigration coming across the southern border. The Lonestar State was sued by the Biden Administration on multiple occasions after Governor Greg Abbott ordered state national guard and law enforcement assets to secure the southern border.

Texas officials constructed their own makeshift barriers in order to deter crossings and deployed national guard assets to the illegal immigration hotspot of Eagle Pass. The state emerged victorious in several legal challenges launched by the Biden Administration, which asserted that the federal government has sole authority over border security.
