BIG WIN: Supreme Court OVERTURNS Ruling Against New Texas Congressional Map

The Supreme Court just granted a major win for Texas and the Republican party ahead of next year’s midterms.

Earlier this week, a lower court tossed out Texas’ new congressional maps, which are likely to give Republicans five more House seats.

Texas’ redistricting is a major shake-up for the 2026 midterm elections, so of course, Democrats are trying to get it thrown out.

But, in a very good sign, SCOTUS just sided with Texas!

On Friday, the Supreme Court issued a temporary restraining order to overturn the lower court’s ruling, at least for now.

Here are the details:

Supreme Court Justice Sam Alito was the one who issued the temporary restraining order on the lower court’s ruling against the Texas congressional maps.

It will remain in effect until SCOTUS is ready to make another decision.

CBS News has more details on the ruling:

Justice Samuel Alito granted the state’s request for an administrative stay, which means the lower court ruling is now on hold until the Supreme Court takes further action…

The state’s redistricting push set of a nationwide effort to redraw House maps ahead of next year’s midterms, with California shifting five congressional districts to the left, and Missouri and North Carolina each shifting a seat to the right. President Trump has pushed other GOP-led states to take similar steps.

But earlier this week, a panel of federal judges blocked Texas from using its new maps in a 2-1 ruling. The court’s opinion, penned by Trump-appointed U.S. District Judge Jeffrey Brown, sided with plaintiffs who argued the map was an unconstitutional racial gerrymander.

The lower court pointed to a majority-White Democratic district that it said should have changed more if the process was driven purely by politics, not race. It also argued that some state officials, like Texas Gov. Greg Abbott, seemed to move in response to a letter by a top Justice Department official warning them to redraw four existing districts that the federal government viewed as illegal “coalition” districts, where non-Hispanic White voters are in the minority, but no racial group has a majority.

In Friday’s request to the Supreme Court, the state of Texas pushed back on these arguments, asserting that the redistricting process was entirely partisan and wasn’t motivated by race.

“From the start, everyone recognized that the purpose of Texas’s redistricting effort was Republican political advantage,” the state wrote, quoting several elected Democrats who criticized the new maps on political grounds.
At this time, we don’t know when SCOTUS will issue a final ruling on the new Texas congressional maps.

But, Texas is urging them to act quickly because of rules about the candidate filing period for 2026.

This temporary restraining order allows candidates to file to run for next year’s elections using the new congressional map’s districts.

The Hill explained:

In practical terms, Alito’s order means candidates will keep filing to run under the new map’s boundaries until the Supreme Court rules.

Alito received Texas’s appeal because he handles emergency requests arising from the state by default. He could act on state’s application alone or refer it to the full court for a vote.

Texas Republicans passed the new map earlier this year after pressure from President Trump to boost the GOP’s chances of keeping control of the House in the midterms. It sparked a mid-decade redistricting arms race that has led to new maps in places like California and North Carolina.

Earlier this week, a panel of federal judges ruled 2-1 that Texas’s new map was likely a racial gerrymander and blocked the state from using it.

It spurred Texas Gov. Greg Abbott (R) to file an emergency appeal at the Supreme Court earlier Friday evening.

“The confusion sown by the district court’s eleventh-hour injunction poses a very real risk of preventing candidates from being placed on the ballot and may well call into question the integrity of the upcoming election,” the application states.

Texas’s candidate filing period closes Dec. 8. Abbott has asked the justices to rule by Dec. 1.
